These Terms and Conditions ("Terms", "Terms and Conditions") govern your access to and use of the BrandzCollage website, mobile application, marketplace, and related services.

By accessing, browsing, registering for, or purchasing through BrandzCollage, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our services.

1. About BrandzCollage

BrandzCollage is an online marketplace operated by BrandzCollage, located at:

BrandzCollage provides an online platform through which customers may discover and purchase products and, where applicable, sellers may list and sell products.

2. Definitions

For these Terms:

• "BrandzCollage", "we", "us", or "our" means BrandzCollage.

• "Website" means https://brandzcollage.com and related BrandzCollage web pages.

• "App" means the BrandzCollage mobile application.

• "Platform" means the Website, App, marketplace, and related services collectively.

• "Customer", "you", or "your" means any person accessing or using the Platform.

• "Seller" means a person or business offering products through the BrandzCollage marketplace.

• "Product" means any item listed for sale through the Platform.

• "Order" means a request submitted by a Customer to purchase one or more Products.

• "Services" means the services provided by BrandzCollage through the Platform.

3. Eligibility

You must be legally capable of entering into a binding agreement to use BrandzCollage.

By using the Platform, you represent that:

• The information you provide is accurate and complete.

• You are legally permitted to use the Platform.

• You will comply with these Terms and applicable laws.

• You will not use the Platform for unlawful or fraudulent purposes.

If you are using BrandzCollage on behalf of a business or organization, you represent that you have authority to bind that organization to these Terms.

4. Account Registration

Certain BrandzCollage features may require you to create an account.

You are responsible for:

• Providing accurate information.

• Keeping your account information up to date.

• Maintaining the confidentiality of your password.

• Protecting your account credentials.

• All activity conducted through your account.

You must notify us promptly if you believe your account has been accessed without authorization.

BrandzCollage is not responsible for losses resulting from your failure to protect your account credentials, except where such responsibility cannot legally be excluded.

5. Use of the Platform

You agree to use BrandzCollage only for lawful purposes.

You must not:

• Use the Platform for fraudulent purposes.

• Create accounts using false or misleading information.

• Impersonate another person or business.

• Attempt to gain unauthorized access to accounts or systems.

• Interfere with Platform security.

• Introduce malware, viruses, or other harmful code.

• Scrape, copy, reproduce, or systematically collect Platform content without permission.

• Use automated systems to access the Platform in a manner that adversely affects its operation.

• Manipulate ratings, reviews, orders, or other marketplace activity.

• Use the Platform to facilitate illegal activities.

• Circumvent security or access controls.

• Attempt to reverse engineer or compromise the Platform.

We may restrict or terminate access where we reasonably believe these Terms have been violated.

6. Products and Product Listings

Products displayed on BrandzCollage may be supplied by BrandzCollage or by independent sellers using our marketplace.

We attempt to ensure that product information is presented accurately. However, product descriptions, images, colors, dimensions, availability, specifications, and other information may occasionally contain errors or differences.

Actual product appearance may vary from images displayed on different devices.

Where a Product is sold by an independent Seller, the Seller is responsible for ensuring that the Product listing is accurate and complies with applicable laws and BrandzCollage policies.

7. Product Availability

Product availability may change without notice.

Adding a Product to your cart does not guarantee that the Product will remain available until checkout is completed.

BrandzCollage or the relevant Seller may cancel an Order if:

• The Product is unavailable.

• There is an inventory error.

• The Product was listed incorrectly.

• There is a pricing or description error.

• The Order appears fraudulent or suspicious.

• The Order violates these Terms.

• Circumstances outside our reasonable control prevent fulfillment.

If an Order is cancelled after payment has been received, the applicable refund will be processed according to our refund procedures and applicable law.

8. Prices

Prices displayed on BrandzCollage are shown in the applicable currency indicated on the Platform.

Prices may change at any time.

Where applicable, the total amount payable may include:

• Product price

• Delivery charges

• Applicable taxes

• Other applicable fees

The applicable price and charges displayed at checkout will generally be the amount applicable to your Order, subject to obvious pricing or technical errors.

9. Orders

When you submit an Order, you are making a request to purchase the selected Products.

Submission of an Order does not necessarily mean that BrandzCollage or the Seller has accepted the Order.

An Order may be accepted, rejected, cancelled, or modified where permitted under these Terms.

Once an Order is accepted, we may send an order confirmation or other notification.

We reserve the right to refuse or cancel Orders where there is a legitimate reason to do so.

10. Payment

BrandzCollage may support multiple payment methods, depending on availability.

Payment may be processed by third-party payment providers.

By submitting payment information, you confirm that:

• You are authorized to use the selected payment method.

• The information provided is accurate.

• You authorize the applicable payment provider to process the transaction.

BrandzCollage may not store complete payment card information where payment processing is handled directly by third-party payment providers.

Payment transactions may be subject to the terms and privacy policies of the applicable payment provider.

11. Cash on Delivery

Where Cash on Delivery ("COD") is available, additional verification may be required before an Order is dispatched.

BrandzCollage or the relevant Seller may contact you using the contact information provided with the Order to verify the Order.

Repeated refusal to accept legitimate COD Orders, fraudulent Orders, or abuse of COD services may result in restrictions or suspension of your account.

12. Delivery

Delivery times displayed on the Platform are estimates unless explicitly stated otherwise.

Delivery may be affected by:

• Seller processing times

• Courier availability

• Weather

• Public holidays

• Address issues

• Transportation disruptions

• Security conditions

• Events outside our reasonable control

You are responsible for providing an accurate and complete delivery address and contact information.

If an Order cannot be delivered because incorrect or incomplete information was provided, additional delivery charges or cancellation may apply where permitted.

13. Receiving an Order

Customers should inspect Products when they are delivered.

Where a Product is damaged, incorrect, incomplete, or otherwise appears inconsistent with the Order, you should report the issue through the applicable BrandzCollage support or return process as soon as reasonably possible.

Evidence such as photographs or videos may be requested to investigate certain claims.

14. Returns and Refunds

Returns and refunds are subject to the applicable BrandzCollage return/refund policy and, where relevant, the individual Seller's applicable policy.

Certain Products may not be eligible for return due to their nature, including Products that are:

• Personalized or customized

• Perishable

• Hygiene-sensitive

• Used or damaged by the Customer

• Specifically identified as non-returnable

A Product may also be subject to specific return conditions displayed on the Product page or at checkout.

Where a return is approved, the Product may need to be returned in its original condition, packaging, accessories, and documentation where applicable.

Refunds will generally be processed using the applicable payment method or another method permitted by our refund procedures.

Processing times may depend on the payment provider, bank, or financial institution.

15. Seller Responsibilities

Sellers using BrandzCollage are responsible for:

• Providing accurate product information.

• Maintaining accurate inventory.

• Setting accurate prices.

• Fulfilling accepted Orders.

• Packaging Products appropriately.

• Complying with applicable laws and regulations.

• Providing Products that match their descriptions.

• Handling returns and customer issues where applicable.

• Ensuring that listed Products are legally permitted to be sold.

• Not listing counterfeit, stolen, prohibited, or unlawful Products.

BrandzCollage may remove listings, restrict seller accounts, suspend sellers, or take other appropriate action where a Seller violates these Terms or applicable policies.

16. Marketplace Role

Where Products are sold by independent Sellers, BrandzCollage primarily provides the technology and marketplace infrastructure that facilitates transactions between Customers and Sellers.

Unless expressly stated otherwise, BrandzCollage does not manufacture or independently verify every Product listed by a Seller.

Accordingly, certain Product-related matters may be the responsibility of the relevant Seller, including:

• Product description

• Product quality

• Product authenticity

• Product legality

• Product availability

• Warranty, where applicable

• Fulfillment

Nothing in these Terms limits any rights that Customers may have under applicable consumer protection laws.

17. Promotions and Discounts

BrandzCollage may offer:

• Promotional codes

• Discounts

• Sales

• Vouchers

• Loyalty benefits

• Limited-time offers

Promotions may have additional terms and conditions.

Unless otherwise stated:

• Promotions cannot be exchanged for cash.

• Promotions may have expiration dates.

• Promotional codes may be limited to one use per customer.

• Promotions may not be combined.

• We may cancel or modify promotions where permitted by law.

18. Reviews and User Content

BrandzCollage may allow Customers and Sellers to submit reviews, ratings, images, comments, or other content.

You are responsible for content you submit.

You must not submit content that:

• Is false or misleading.

• Is defamatory or abusive.

• Contains unlawful material.

• Infringes another person's intellectual property.

• Contains personal information belonging to another person without authorization.

• Contains malicious code.

• Is spam or promotional material unrelated to the Product.

By submitting content to BrandzCollage, you grant BrandzCollage a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and adapt that content for operating, promoting, and improving our services, subject to applicable law.

We may remove content that violates these Terms or applicable policies.

19. Intellectual Property

The BrandzCollage Platform and its content may contain intellectual property owned by or licensed to BrandzCollage, including:

• Brand names

• Logos

• Designs

• Software

• Website layouts

• Mobile application interfaces

• Graphics

• Text

• Images

• Product presentation elements

• Trademarks

Except as expressly permitted by us or applicable law, you may not:

• Copy substantial portions of the Platform.

• Reproduce our branding.

• Modify or create derivative works from our software.

• Distribute our proprietary content.

• Use BrandzCollage trademarks without authorization.

• Reverse engineer or attempt to extract source code from our software.

Seller-provided content remains subject to the rights of the relevant Seller or rights holder.

20. Mobile Application

The BrandzCollage mobile application may be downloaded through supported application stores.

Your use of the App is also subject to the applicable terms and conditions of the relevant application store.

You agree not to:

• Modify or tamper with the App.

• Attempt to bypass security mechanisms.

• Reverse engineer the App except where permitted by applicable law.

• Distribute unauthorized versions of the App.

• Use the App to interfere with BrandzCollage systems.

We may release updates, patches, or new versions of the App. Some functionality may require you to install updates.

21. Third-Party Services

BrandzCollage may use or integrate with third-party services, including:

• Payment processors

• Delivery providers

• Analytics providers

• Cloud infrastructure

• Authentication services

• Communication services

• Mapping services

• Other technology providers

Third-party services may have their own terms and privacy policies.

BrandzCollage is not responsible for the independent policies or practices of third-party services except where responsibility is imposed by applicable law.

22. Privacy

Your use of BrandzCollage is also governed by our Privacy Policy.

Our Privacy Policy explains how we collect, use, store, and disclose personal information.

By using BrandzCollage, you acknowledge that you have reviewed our Privacy Policy.

23. Account Suspension and Termination

We may suspend, restrict, or terminate your account or access to BrandzCollage if:

• You violate these Terms.

• You provide false or misleading information.

• You engage in fraudulent activity.

• You abuse the marketplace.

• You repeatedly violate return or payment procedures.

• You interfere with Platform security.

• Your activity creates a risk to BrandzCollage or other users.

• We are required to do so by law.

• We otherwise have a legitimate reason to restrict access.

Where appropriate, we may provide notice before taking action.

Termination does not eliminate obligations that arose before termination.

24. Disclaimer

To the extent permitted by applicable law, BrandzCollage provides the Platform on an "as available" basis.

We do not guarantee that:

• The Platform will always be available.

• The Platform will be completely error-free.

• Every Product listing will always be accurate.

• Products will always be available.

• Orders will always be fulfilled.

• Delivery will occur within a particular estimated timeframe.

Nothing in these Terms excludes rights or protections that cannot legally be excluded under applicable law.

25. Limitation of Liability

To the maximum extent permitted by applicable law, BrandzCollage will not be liable for indirect, incidental, special, consequential, or punitive losses arising from your use of the Platform.

This may include loss arising from:

• Temporary Platform interruptions

• Third-party service failures

• Delivery delays outside our reasonable control

• Unauthorized account access caused by the user's failure to protect credentials

• Information supplied incorrectly by a Customer or Seller

• Events beyond our reasonable control

Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law, including liability arising from fraud, willful misconduct, or other matters for which exclusion is prohibited.

26. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold BrandzCollage, its officers, employees, contractors, and service providers harmless from claims, losses, liabilities, damages, and expenses arising from:

• Your violation of these Terms.

• Your misuse of the Platform.

• Your violation of applicable law.

• Your infringement of another person's rights.

• Content you submit to BrandzCollage.

• Fraudulent or unauthorized activity conducted through your account.

This provision does not apply to the extent that the claim results from BrandzCollage's own unlawful conduct or liability that cannot legally be excluded.

27. Force Majeure

BrandzCollage will not be responsible for failure or delay in performing obligations where the failure or delay results from circumstances beyond our reasonable control.

Such circumstances may include:

• Natural disasters

• Floods

• Earthquakes

• Fires

• Epidemics or pandemics

• War

• Terrorism

• Civil unrest

• Government actions

• Internet or telecommunications failures

• Power outages

• Transportation disruptions

• Strikes

• Failures of third-party service providers

28. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will update the "Last Updated" date at the beginning of these Terms.

If changes are material, we may provide additional notice where appropriate.

Your continued use of BrandzCollage after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

29. Governing Law

These Terms shall be governed by and interpreted in accordance with the applicable laws of Pakistan.

Subject to applicable consumer protection and other mandatory legal rights, disputes relating to these Terms or your use of BrandzCollage shall be subject to the jurisdiction of the competent courts in Pakistan.

30. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary to make it enforceable where legally permitted.

The remaining provisions will continue to remain in effect.

31. No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce that provision in the future.

32. Entire Agreement

These Terms, together with our Privacy Policy and any additional policies or terms displayed on the Platform, constitute the agreement between you and BrandzCollage concerning your use of the Platform, except where additional terms expressly apply to a particular service or transaction.
